Welcome, and thanks for stopping by. These Terms & Conditions (our "Terms") are the agreement between you and us. Please read them carefully before you browse the site or place an order, because they explain your rights and ours.

1. Who these Terms are between

This website, https://katiekrafts.com (the "Site"), is owned and operated by VERASCALE LLC, a limited liability company that does business as "Katie Krafts." In these Terms, "Katie Krafts," "we," "us," and "our" all mean VERASCALE LLC dba Katie Krafts, and "you" and "your" mean the person using the Site or placing an order.

By visiting the Site, browsing our products, or placing an order, you agree to be bound by these Terms and by any policies we reference here, including our Shipping Policy, our Refund & Return Policy, and our Privacy Policy. If you do not agree with these Terms, please do not use the Site or place an order.

2. About us

We are a small, family-spirited leather shop. Every piece we make is handmade to order, one at a time, by real hands. We craft custom cowboy hats, custom-fit cowboy boots, a leather wallet, and a leather flask. We are based in Florida, we sell in United States Dollars (USD), and we currently ship within the United States only. Email is the best and only way to reach us, and we are glad to help.

3. Eligibility

To place an order, you must be at least 18 years old and able to enter into a binding contract, or you must have the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. By placing an order, you confirm that this is true and that the information you give us is accurate and complete. We may refuse service to anyone who does not meet these requirements.

4. Our products

Everything we sell is genuinely handmade and made to order. Because leather is a natural material and each item is crafted individually by hand, slight natural variation in the leather, color, grain, texture, and finish is normal and expected. These variations are part of the character of real, handmade western goods, and they are not defects or grounds for a return.

Product photos are meant to show our craftsmanship as honestly as possible, but colors and details may look a little different on your screen than they do in person, and no two pieces are ever exactly alike.

Sizing and fit, especially for our custom-fit cowboy boots and cowboy hats, are made to the measurements, details, and specifications you provide to us when you order. Please double-check your measurements and choices carefully before you submit them, because we build each order to what you tell us. We are not responsible for fit or sizing issues that result from inaccurate or incomplete information provided by you.

5. Orders and order acceptance

When you place an order through the Site, you are making an offer to buy the item on these Terms. Your order is not accepted, and no contract is formed, until we confirm acceptance of your order, which normally happens when we send you an order confirmation or begin making your item.

We reserve the right, at our discretion, to refuse, limit, or cancel any order, in whole or in part, for any lawful reason. This includes situations such as an item being unavailable, an error in pricing or product information, a problem with payment, or a suspected fraudulent or unauthorized transaction. If we cancel an order after you have already paid, we will refund the amount you paid for the cancelled portion.

6. Pricing and payment

All prices are shown in United States Dollars (USD). We work hard to keep pricing accurate, but prices, product details, and availability may change at any time without notice. If we discover a pricing or description error affecting your order, we may cancel the order or contact you before proceeding.

You are responsible for any applicable taxes, which may be calculated and added at checkout as required by law. By submitting payment information, you represent that you are authorized to use the payment method and you authorize us and our payment processors to charge the full order amount, including any taxes and applicable shipping charges. Payments are handled by third-party payment processors, and we do not store your full payment card details.

7. Shipping

We currently ship within the United States only. Because our items are made to order, please allow time for us to craft your piece before it ships. Full details on processing times, shipping methods, costs, and delivery are set out in our Shipping Policy, which is part of these Terms. Please review it for the current information.

8. Returns, refunds, and cancellations

We stand behind our work. How returns, refunds, and cancellations are handled, including the rules that apply to custom and made-to-order items, is explained in our Refund & Return Policy, which is part of these Terms. Because most of what we make is custom and built specifically for you, some items may not be eligible for return or cancellation once production has begun. Please read our Refund & Return Policy carefully before ordering.

9. Intellectual property

All content on the Site, including our name, logos, product designs, photographs, images, graphics, text, and other materials, is owned by us or our licensors and is protected by intellectual property and other laws. "Katie Krafts" and our logos are our trademarks and may not be used without our written permission.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the Site for your own personal, non-commercial use. You may not copy, reproduce, republish, distribute, sell, modify, or create derivative works from any of our content without our prior written consent, except as expressly permitted by law.

10. Acceptable use

You agree to use the Site lawfully and respectfully. In particular, you agree that you will not:

Use the Site for any unlawful, fraudulent, or harmful purpose, or in violation of these Terms;
Attempt to gain unauthorized access to the Site, our systems, other users' accounts, or any related networks or data;
Introduce viruses, malware, or any other harmful or disruptive code;
Interfere with, overload, or disrupt the operation, security, or integrity of the Site;
Use automated tools such as bots, scrapers, or crawlers to access or collect data from the Site without our permission;
Infringe our intellectual property rights or those of any third party; or
Submit false, misleading, or fraudulent information, including payment or order details.

We may suspend or terminate your access to the Site if you violate these Terms or misuse the Site.

11. Disclaimers and warranties

We put real care into everything we make. That said, to the fullest extent permitted by law, the Site and our products are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

As explained above, our goods are handmade to order, and natural variation in leather, color, grain, texture, and finish is expected and is not a defect. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any content is accurate, complete, or current. Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you, and nothing in these Terms limits any rights you have that cannot be limited under applicable law.

12. Limitation of liability

To the fullest extent permitted by law, in no event will VERASCALE LLC dba Katie Krafts, or its owners, members, employees, or contractors, be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to your use of the Site or our products, whether based on contract, tort, warranty, or any other legal theory, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms, the Site, or any product will not exceed the amount you actually paid to us for the product giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless VERASCALE LLC dba Katie Krafts, and its owners, members, employees, and contractors, from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your violation of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party.

14. Governing law and dispute resolution

These Terms and any dispute or claim arising out of or relating to them, the Site, or our products are governed by the laws of the State of Florida, United States, without regard to its conflict of law rules. You agree that the state and federal courts located in the State of Florida will have exclusive jurisdiction and venue over any dispute that is not otherwise resolved, and you consent to the personal jurisdiction of those courts. Before starting any formal proceeding, we encourage you to contact us by email so we can try to resolve the matter directly.

15. Changes to these Terms

We may update these Terms from time to time to reflect changes in our practices, our products, or the law. When we do, we will revise the "Effective date" above and post the updated Terms on the Site. Changes take effect when they are posted. Your continued use of the Site or placing of an order after the updated Terms are posted means you accept the changes, so please check back periodically.

16. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force and effect.

17. Entire agreement

These Terms, together with our Shipping Policy, our Refund & Return Policy, our Privacy Policy, and any other policies or notices we post on the Site, make up the entire agreement between you and us regarding your use of the Site and our products, and they replace any prior agreements or understandings on that subject. Our failure to enforce any provision is not a waiver of our right to do so later.
